Collection and Use of Personal Information

Personal information is data that can be used to identify or contact a single person.

You may be asked to provide your personal information anytime you are in contact with TPT Med Tech or affiliated company. TPT Med Tech and its affiliates may share this personal information with each other and use it consistent with this Privacy Policy. They may also combine it with other information to provide and improve our products, services, content, and advertising. You are not required to provide the personal information that we have requested, but, if you chose not to do so, in many cases we will not be able to provide you with our products or services or respond to any queries you may have.

How we use your personal information

We may process your personal information: for the purposes described in this Privacy Policy, with your consent, for compliance with a legal obligation to which TPT Med Tech is subject, for the performance of a contract to which you are party, in order to protect your vital interests, or when we have assessed it is necessary for the purposes of the legitimate interests pursued by TPT Med Tech or a third party to whom it may be necessary to disclose information. The personal information we collect allows us to keep you posted on TPT Med Tech’s latest product announcements, software updates, and upcoming events. If you don’t want to be on our mailing list, you can opt-out anytime by updating your preferences.

We also use personal information to help us create, develop, operate, deliver, and improve our products, services, content and advertising, and for loss prevention and anti-fraud purposes. We may also use your personal information for account and network security purposes, including in order to protect our services for the benefit of all our users, and pre-screening or scanning uploaded content for potentially illegal content, including child sexual exploitation material. Where we use your information for anti-fraud purposes it arises from the conduct of an online transaction with us. We limit our uses of data for anti-fraud purposes to those which are strictly necessary and within our assessed legitimate interests to protect our customers and our services. For certain online transactions we may also validate the information provided by you with publicly accessible sources.

We may use your personal information, including date of birth, to verify identity, assist with identification of users, and to determine appropriate services. 

From time to time, we may use your personal information to send important notices, such as communications about purchases and changes to our terms, conditions, and policies. Because this information is important to your interaction with TPT Med Tech, you may not opt out of receiving these communications.

We may also use personal information for internal purposes such as auditing, data analysis, and research to improve TPT Med Tech’s products, services, and customer communications.

If you enter into a sweepstake, contest, or similar promotion we may use the information you provide to administer those programs.

If you apply for a position at TPT Med Tech or we receive your information in connection with a potential role at TPT Med Tech, we may use your information to evaluate your candidacy and to contact you. If you are a candidate, you will receive more information about how TPT Med Tech handles candidate personal information at the time of application.

Source of your personal information where they are not collected from you

We may have received your personal information from other persons if that person has shared their content with you using TPT Med Tech products, sent gift certificates and products, or invited you to participate in TPT Med Tech services or forums.

If you are a potential candidate for employment with TPT Med Tech, we may have received your personal information from third parties such as recruiters or external websites. We will use the personal information we receive to contact you about a potential opportunity or in evaluating your candidacy. If you did not provide us your personal information directly, we will inform you of the source when we first contact you regarding your candidacy. For research and development purposes, we may use datasets such as those that contain images, voices or other data that could be associated with an identifiable person. When acquiring such datasets, we do so in accordance with applicable law in the jurisdiction in which the dataset is hosted. When using such datasets for research and development, we do not attempt to re-identify individuals who may appear therein.

Collection and Use of Non-Personal Information

We also collect data in a form that does not, on its own, permit direct association with any specific individual. We may collect, use, transfer, and disclose non-personal information for any purpose. The following are some examples of non-personal information that we collect and how we may use it:

We may collect information such as occupation, language, zip code, area code, unique device identifier, referrer URL, location, and the time zone where an TPT Med Tech product is used so that we can better understand customer behavior and improve our products, services, and advertising.

We may collect and store details of how you use our services, including search queries. This information may be used to improve the relevancy of results provided by our services. Except in limited instances to ensure quality of our services over the Internet, such information will not be associated with your IP address.

With your explicit consent, we may collect data about how you use your device and applications in order to help app developers improve their apps.

If we do combine non-personal information with personal information the combined information will be treated as personal information for as long as it remains combined.

Cookies and Other Technologies

TPT Med Tech’s websites, online services, interactive applications, email messages, and advertisements may use “cookies” and other technologies such as pixel tags and web beacons. These technologies help us better understand user behavior, tell us which parts of our websites people have visited, and facilitate and measure the effectiveness of advertisements and web searches. We treat information collected by cookies and other technologies as non‑personal information. However, to the extent that Internet Protocol (IP) addresses or similar identifiers are considered personal information by local law, we also treat these identifiers as personal information. Similarly, to the extent that non-personal information is combined with personal information, we treat the combined information as personal information for the purposes of this Privacy Policy.

TPT Med Tech also uses cookies and other technologies to remember personal information when you use our website, online services, and applications. Our goal in these cases is to make your experience with TPT Med Tech more convenient and personal. For example, knowing your first name lets us welcome you the next time you visit a QuikLAB™.

If you want to disable cookies and you’re using the Safari web browser, go to Safari preferences and then to the privacy pane to manage your preferences. On a Apple mobile device, go to Settings, then Safari, scroll down to the Privacy & Security section, and tap on “Block Cookies” to manage your preferences. For other browsers, check with your provider to find out how to disable cookies. Please note that certain features of the TPT Med Tech website will not be available once cookies are disabled.

As is true of most internet services, we gather some information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser type and language, Internet service provider (ISP), referring and exit websites and applications, operating system, date/time stamp, and clickstream data. We use this information to understand and analyze trends, to administer the site, to learn about user behavior on the site, to improve our product and services, and to gather demographic information about our user base as a whole. TPT Med Tech may use this information in our marketing and advertising services.

In some of our email messages, we use a “click-through URL” linked to content on the TPT Med Tech website. When customers click one of these URLs, they pass through a separate web server before arriving at the destination page on our website. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked in this way, you should not click text or graphic links in the email messages. Pixel tags enable us to send email messages in a format customers can read, and they tell us whether mail has been opened. We may use this information to reduce or eliminate messages sent to customers.

Disclosure to Third Parties

At times TPT Med Tech may provide third parties with certain personal information to provide or improve our products and services, including to deliver products at your request, or to help TPT Med Tech market to consumers. When we do, we require those third parties to handle it in accordance with relevant laws. TPT Med Tech does not sell personal information, and personal information will never be shared with third parties for their marketing purposes. 

Service Providers

TPT Med Tech shares personal information with companies who provide services such as information processing, extending credit, fulfilling customer orders, delivering products to you, managing and enhancing customer data, providing customer service, assessing your interest in our products and services, and conducting customer research or satisfaction surveys. These companies are obligated to protect your information and may be located wherever TPT Med Tech operates.

Others

It may be necessary − by law, legal process, litigation, and/or requests from public and governmental authorities within or outside your country of residence − for TPT Med Tech to disclose your personal information. We may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate. We may also disclose information about you, but only where there is a lawful basis for doing so, if we determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations or users.  This could include providing information to public or governmental authorities. Additionally, in the event of a reorganization, merger, or sale we may transfer any and all personal information we collect to the relevant third party.

Protection of Personal Information

TPT Med Tech takes the security of your personal information very seriously. TPT Med Tech online services such as the TPT Med Tech Online Store and QuikLAB™ protect your personal information during transit using encryption such as Transport Layer Security (TLS). When your personal data is stored by TPT Med Tech, we use computer systems with limited access housed in facilities using physical security measures

When you use some TPT Med Tech products, services, or applications or post on an TPT Med Tech forum, chat room, or social networking service, the personal information and content you share is visible to other users and can be read, collected, or used by them. You are responsible for the personal information you choose to share or submit in these instances. For example, if you list your name and email address in a forum posting, that information is public. Please take care when using these features.

The Existence of Automated Decision-Making, Including Profiling

TPT Med Tech does not take any decisions involving the use of algorithms or profiling that significantly affect you.

Integrity and Retention of Personal Information

TPT Med Tech makes it easy for you to keep your personal information accurate, complete, and up to date. We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy and our service specific privacy summaries. When assessing these periods we carefully examine our need to collect personal information at all and if we establish a relevant need we only retain it for the shortest possible period to realize the purpose of collection unless a longer retention period is required by law.

Security of Health Information and Personal Information

We maintain a variety of physical, electronic, and procedural safeguards designed to protect your Health Information and Personal Information and prevent unauthorized access when the information is in our control. However, you should remember that no system can perfectly prevent an unauthorized person from intentionally viewing information while it is in transit over the Internet or via email. Therefore, TPT Med Tech cannot and does not guarantee the confidentiality or security of information you send to us via the Internet or by email.

Your Privacy Rights

We may decline to process requests that are frivolous/vexatious, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law. We may also decline aspects of deletion or access requests if we believe doing so would undermine our legitimate use of data for anti-fraud and security purposes as described earlier. 

California

The California Consumer Privacy Act provides California consumers with the right to obtain from TPT Med Tech information about the personal information about you that we collect, use, and disclose. You or your agent can make a request to info@tptmedtech.com or by calling 619-664-4006. If you choose to exercise your privacy rights, you have the right to not to receive discriminatory treatment or a lesser degree of service from TPT Med Tech.

Nevada

You have the right to opt-out of the sale of your personal information. TPT Med Tech does not sell your personal information.

Children & Education

We understand the importance of taking extra precautions to protect the privacy and safety of children using TPT Med Tech products and services. Children under the age of 13, or equivalent minimum age in the relevant jurisdiction, are not permitted to use this site, unless their parent provided verifiable consent 

If we learn that we have collected the personal information of a child under 13, or equivalent minimum age depending on jurisdiction, outside the above circumstances we will take steps to delete the information as soon as possible. 

Location-Based Services

To provide location-based services on TPT Med Tech products, TPT Med Tech and our partners and licensees, such as maps data providers, may collect, use, and share precise location data, including the real-time geographic location of your TPT Med Tech computer or device. Where available, location-based services may use GPS, Bluetooth, and your IP Address, along with crowd-sourced Wi-Fi hotspot and cell tower locations, and other technologies to determine your devices’ approximate location. Unless you provide consent, this location data is collected anonymously in a form that does not personally identify you and is used by TPT Med Tech and our partners and licensees to provide and improve location-based products and services. For example, your device may share its geographic location with application providers when you opt in to their location services.

Some location-based services offered by TPT Med Tech require your personal information for the feature to work.

Third‑Party Sites and Services

TPT Med Tech websites, products, applications, and services may contain links to third-party websites, products, and services. Our products and services may also use or offer products or services from third parties − for example, a third‑party iPhone app.

Information collected by third parties, which may include such things as location data or contact details, is governed by their privacy practices. We encourage you to learn about the privacy practices of those third parties.

MEDICAL PRIVACY

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN ACCESS THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our Pledge Regarding Your Health Information:

We understand that information about you and your health is confidential. We are committed to protecting the privacy of this information. Each time you visit a TPT MED TECH lab or facility, we create a record of the care and services you receive. We need this record to provide you with quality care and to comply with certain legal requirements. This notice applies to all of the records of your care generated by any of the TPT Med Tech LLC entities, whether made by health care personnel or your physician.

This notice tells you about how we may use and disclose health information about you, as well as certain obligations we have regarding the use and disclosure of health information. It also describes your rights regarding your health information.

Our Responsibilities:

Our primary responsibility is to safeguard your personal health information. We must give you this notice of our privacy practices, and follow the terms of the notice currently in effect. We will notify you in the event we become aware of unauthorized access, use or disclosure of your unsecured protected health information. Changes to this notice: We reserve the right to change this notice. We reserve the right to make the revised or changed notice effective for health information we already have about you as well as any information we receive in the future.  

How We May Use and Disclose Health Information About You:

The following categories describe different ways that we use your health information within TPT Med Tech, LLC and disclose your health information to persons and entities outside of TPT Med Tech, LLC. We have not listed every use or disclosure within the categories below, but all permitted uses and disclosures will fall within one of the following categories. In addition, there are some uses and disclosures that require your specific authorization.

Treatment:

We use and disclose your protected health information to provide, coordinate or manage your health care and any related services. We may disclose health information about you to doctors, nurses, technicians, medical students, interns or other allied health personnel who are involved in taking care of your medical or pastoral needs during your visit with us. We may communicate information to another non-TPT Med Tech, LLC health care provider for the purposes of coordinating your continuing care, and may make that information available electronically.  

Payment:

We may use and disclose your information to bill for services provided by TPT Med Tech and to obtain payment from you, an insurance company, a third party or a collection agency. This may include the disclosure of health information to obtain prior authorization for treatment and procedures from your insurance plan.

Health Care Operations:

Uses and disclosures of health information are necessary to operate our health care facility and to make sure all of our patients receive quality care. We may use and disclose relevant health information about you for health care operations. Examples include quality assurance activities, post-discharge telephone calls to follow up on your health status, medical staff credentialing, administrative activities including   Health financial and business planning and development, customer service activities including patient satisfaction surveys, investigation of complaints and certain marketing activities such as health education options for treatment and services.

Business Associates:

TPT Med Tech Health provides services through contracts with business associates. Examples of business associates include accreditation agencies, management consultants, quality assurance reviewers and billing Your Rights Regarding Medical Information About You  You have the following rights regarding medical information we maintain about you. You may contact a health information representative where services were provided to obtain additional information and instructions for exercising the following rights.  Obtain a copy of our Notice of Privacy Practices.  Request a restriction on certain uses and disclosures of your information. This request must be in writing. If we agree to your request, we will comply unless the information is needed to provide you with emergency treatment.  However, if our system capabilities will not allow us to comply with your request, we are not required to agree to your request.

Services paid for out of pocket:

We must however agree to your request to restrict disclosure of your health information to your health plan (or insurer of healthcare services) for purposes of payment or operations if the PHI pertains solely to a healthcare item or service for which you, or someone else on your behalf (other than the health plan or insurer), had paid for the item or service out of pock in full at the time of service. We can only address requests for TPT Med Tech LLC affiliated facilities. Your request will not extend to a physician’s private practice.

Inspect and request a copy of your health record.

Your request for inspection or copies, including electronic copies, must be in writing and directed to the TPT Med Tech entity where your services were provided. A reasonable fee for copies will be charged. We may deny your request under very limited circumstances. If you are denied access to health information, you may request that the denial be reviewed by another health care professional chosen by someone on our health care team. We will abide by the outcome of that review. Request an amendment to your health record if you feel the information is incorrect or incomplete. Your request must be made in writing and it must include a reason that supports the request. We may deny your request if the information was not created by our health care team; if it is not part of the information kept by our facility; if it is not part of the information which you are permitted to inspect and copy; or if the information is accurate and complete as stated. Please note: if we accept your request for amendment, we are not required to delete any information from your health record.

Obtain an accounting of disclosures to others of your health information.

The accounting will provide information about disclosures made for purposes other than treatment, payment, health care operations, disclosures excluded by law or those you have authorized.

Request confidential communications.

You have the right to request that we communicate with you about medical matters in a certain way or at a certain location. For example, you may ask that we only contact you at work or by mail.  We will accommodate all requests that are reasonable for our system capabilities. Your request must be in writing and specify the exact changes you are requesting.

Revoke your authorization.

You have the right to revoke your authorization for the use or disclosure of your health information except to the extent that action has already been taken.  Complain about any aspect of our health information practices to us or to the United States Department of Health and Human Services. Notice of Privacy Practices Notice of Privacy Practices and collection services.

We disclose your health information to our business associates so they can perform the job we’ve asked them to do. To protect your health information, we require our business associates to sign a contract or written agreement that states they will appropriately safeguard your information.

Special Situations That Do Not Require Your Authorization

State or federal law permits the following disclosures of your health information without verbal or written permission from you.

Research:

We may disclose protected health information about you when preparing to conduct a research project, as long as the protected health information does not leave TPT Med Tech, LLC.

Military and Veterans:

If you are a member of the armed forces, we may release health information about you as required by military command authorities.

Worker’s Compensation:

We may release health information about you for worker’s compensation or similar programs if you have a work-related injury. These programs provide benefits to you for your work-related injuries. 

Averting a Serious Threat to Health or Safety: 

We may use and disclose health information about you, when necessary, to prevent a serious threat to your health or safety or the health and safety of another person or the public.  These disclosures would be made only to someone able to help prevent the threat. 

Health Oversight Activities:

We disclose health information to a health oversight agency for activities authorized by law. These oversight activities include audits, investigations, inspections and licensure. These activities are necessary for the government to monitor the health care system, government programs and compliance with civil rights laws.

Public Health Activities:

We may disclose health information about you for public health activities.  These generally include the following:

  • To prevent or control disease, injury or disability
  • To report births and deaths
  • To report child and adult abuse or neglect
  • To report reactions to medications, problems with products or other adverse events
  • To notify people of recalls of products they may be using
  • To notify a person who may have been exposed to a disease or may be at risk for contracting or spreading a disease or condition

Lawsuits and Disputes:

If you are involved in a lawsuit or a dispute, we may disclose health information about you in response to a court or administrative order. We may disclose health information about you in response to a subpoena, discovery request or other lawful process by someone else involved in the dispute.

Law Enforcement:

We may disclose health information if asked to do so by law enforcement officials for the following reasons:

  • In response to a court order, subpoena, warrant, summons or similar process
  • To identify or locate a suspect, fugitive, material witness or missing person
  • To identify the victim of a crime if, under certain circumstances, we are unable to obtain the person’s     authorization
  • To release information about a death we believe may be the result of criminal conduct
  • Criminal conduct at our facility
  • Emergency circumstances, to report a crime, the location of the crime or victims, or the identity, description or location of the person who committed the crime

Coroners, Medical Examiners and Mortuaries:

We may disclose health information to a coroner or medical examiner.  This may be necessary to identify a deceased person or determine the cause of death of a person. We may release health information about patients at our facility to mortuaries as necessary to carry out their duties.

National Security and Intelligence Activities:

We may disclose health information about you to authorized federal officials for intelligence, counterintelligence and other national security activities authorized by law.

Inmates:

If you are an inmate of a correctional institution or under custody of a law enforcement official, we may disclose health information about you to the correctional institution or the law enforcement official. This is necessary for the correctional institution to provide you with health care, to protect your health and safety and the health and safety of others or for the safety and security of the correctional institution.

Legal Requirements:

We disclose health information about you without your permission when required to do so by federal, state or local law.

Individuals Involved in Your Care or Payment for Your Care:

We may disclose health information about you to a family member or friend who is involved in your medical care, unless you tell us in advance not to do so.  At TPT Med Tech, LLC, we may disclose health information about you to an entity assisting in a disaster relief effort (such as the Red Cross) so that your family can be notified about your condition, status and location.

Situations Requiring Your Written Authorization:

If there are reasons we need to use your information that have not been described in the sections above, we will obtain your written permission. This permission is described as an “authorization.” If you authorize us to use or disclose health information about you, you may revoke that authorization in writing at any time. If you revoke your authorization, we will no longer use or disclose health information about you for the reasons stated in your written authorization. Please understand that we are unable to take back any disclosures we have already made with your permission, and we are required to retain our records of the care we provide to you. Listed below are some typical disclosures that require your authorization.

Special Categories of Treatment Information:

In most cases, federal or state law requires your written authorization or the written authorization of your representative, for disclosure of drug and alcohol abuse treatment, Human Immunodeficiency Virus (HIV) and Acquired Immune Deficiency Syndrome (AIDS) test results, and mental health treatment.

Sale of Health Information:

It is not TPT Med Tech, LLC’s practice to sell your health information. Sale of your health information would require your written authorization.

Research:

When a research study involves your treatment, or, in certain circumstances, records research, we may disclose your health information to researchers only after you have signed a specific written authorization. In addition, TPT Med Tech, LLC will already have reviewed the research proposal, established appropriate protocols to ensure the privacy of your health information and approved the research. You do not have to sign the authorization, but if you refuse you cannot be part of the research study and may be denied research-related treatment.

Marketing:

Under most circumstances, we obtain your authorization for TPT Med Tech, LLC related marketing activities.

Some exceptions are when we have a direct face-to-face communication; if we give you a gift that is of nominal value or if the activity is to provide you with information about TPT Med Tech, LLC products or services.

Fundraising:

For fundraising purposes, we will obtain your authorization except for our own fundraising purposes. You may opt-out of receiving such communication, and opt back in upon request Information on how to do so will be available on fundraising communications and on our web page.

California Privacy Rights

Your Privacy Rights — Notice to California Residents

Your California Privacy Disclosures

California consumers have a right to knowledge, access, and deletion of their personal information under the California Consumer Privacy Act. California consumers also have a right to opt out of the sale of their personal information by a business and a right not to be discriminated against for exercising one of their California privacy rights. TPT Med Tech does not sell the personal information of California consumers and does not discriminate in response to privacy rights requests.

TPT Med Tech provides notice of our privacy practices in our Privacy Policy. The Privacy Policy includes what personal information is collected, the source of the personal information, and the purposes of use, as well as whether TPT Med Tech discloses that personal information and if so, the categories of third parties to whom it is disclosed.

If you are a California consumer and you or your authorized agent would like to exercise your privacy rights, requests may be made to info@tptmedtech.com, or by calling 1-619-664-4006. TPT Med Tech will ask you for information which we consider necessary to verify your identity for security and to prevent fraud. This information may include name, contact information, and information related to your transaction or relationship with TPT Med Tech, but the specific information requested may differ depending on the circumstances of your request for your security and to protect privacy rights. If we delete your personal information, we will both render certain personal information about you permanently unrecoverable and also deidentify certain personal information.

Do Not Track

TPT Med Tech does not track its customers over time and across third party websites to provide targeted advertising and therefore does not respond to Do Not Track (DNT) signals. Third parties that have content embedded on TPT Med Tech’s websites such as a social feature or a stock ticker may set cookies on a user’s browser and/or obtain information about the fact that a web browser visited a specific TPT Med Tech website from a certain IP address. Third parties cannot collect any other personally identifiable information from TPT Med Tech’s websites unless you provide it to them directly.

Notice for Minors

TPT Med Tech offers interactive services which allow you to post content to share publicly or with friends.  At any time you can delete or remove content you have posted using the deletion or removal options within our services.  If you have questions about how to remove content in a specific service or if you would like additional assistance with deletion you can contact our TPT Med Tech Support team directly info@tptmedtech.com.  Although we offer deletion capability for our services, you should be aware that the removal of content may not ensure complete or comprehensive removal of that content or information posted through the services.

Privacy Questions

If you have any questions or concerns about TPT Med Tech’s Privacy Policy or data processing, you would like to contact our Data Protection Officer, or if you would like to make a complaint about a possible breach of local privacy laws, please contact us.

When a privacy question or question about personal information received in response to an access/download request is received we have a dedicated team which triages your contact to address your issue. Where your issue may be more substantive in nature, we may request more information from you. All such substantive contacts receive a response within seven (7), days wherever possible – providing a response on the issue raised, requesting additional information where necessary or indicating that a response will require additional time. You may at any time refer your complaint to the relevant regulator in your jurisdiction if you are unsatisfied with a reply received from us. If you ask us, we will endeavor to provide you with information about relevant complaint avenues which may be applicable to your circumstances.

Where your complaint indicates an improvement could be made in our handling of privacy issues we will take steps to make such an update at the next reasonable opportunity. In the event that a privacy issue has resulted in a negative impact on you or another person we will take steps to address that with you or that other person.

TPT Med Tech may update its Privacy Policy from time to time. When we change the policy in a material way, a notice will be posted on our website along with the updated Privacy Policy.
